Sending your personal data through the web www.laborviva.com giving New Distributor constitutes acceptance of the following general terms and conditions for the purchase of items advertised on the web as well as for ordering custom items via email.
These general conditions of sale (hereinafter “Purchasing Conditions”) govern the sale of products offered to the public by FEYCSA EEC through the online store located at the URL www.latiendalaborviva.com, hereinafter the website for the professional public (hereinafter distributor)
ACCESSION TO THE GENERAL CONDITIONS AS DISTRIBUTOR
By completing and submitting the application form New Distributor implies full and unreserved acceptance of each and every one of the General Conditions of Purchase herein accession.
The data required to register as a customer-supplier are contact details and CIF / VAT tax.
Purchase Orders referring to these Terms and Conditions are to be pursuing those FEYCSA EEC (LABOR VIVA) by electronic means via e-mail or fax. .
Distributors made minimum orders of 50 units with a minimum annual purchase volume of 200 units to benefit from the dealer fee.
CONFIRMATION OF ORDER AND DESIGN
FEYCSA EEC (LABOR VIVA) providing dealers use applications that allow them to design themselves the previous design or we will design from our creative department in response to the instructions provided.
In both cases, FEYCSA EEC (LABOR VIVA) shall send a pro forma invoice attaching the previous design for approval to the design and the quantities and price of the order. The distributor must be returned by mail / fax to the pro-LABOR VIVA shape and design signed and sealed as a formal acceptance of the order.
All prices advertised on the web are always understood including VAT and led to the end customer. Orders to foreign distributors are exempt from VAT. Distributors have access to a distributor RATE profit margin for its brokerage and applicable discounts for volume order. .
PAYMENT IN NATIONAL AND INTERNATIONAL TRANSACTIONS
Accepted the request and sent the conformity of the design, the payment shall be as follows:
Less than 300 € payment orders will advance to the acceptance of the pro-forma by bank transfer to the account of FEYCSA (LABOR VIVA)

On orders over 250 units will be paid in advance 30% on acceptance of the pro-forma. The remaining 30 days of the date of issuance of the invoice.
The payment of debit orders is 30 days from the date of the invoice. Authorizing direct debits (SEPA, Single Euro Payments Area) must be submitted duly completed, signed and stamped with the acceptance of the pro-forma by the first order.
Transactions with national and international distributors will be guaranteed by the Spanish Insurance Company Export Credit (CESCE) and the remainder outside this coverage payment must be paid in advance by bank transfer to the above bank account.
MODE OF DELIVERY (INCOTERMS)
The sale shall take place in DAP (Delivered at Place) destination (for Europe) and FOB (Free on Board) shipping port in Spain (other countries and shipping), submitting the contracting parties regarding the interpretation of the trade term, international rules issued by the International Chamber of Commerce (INCOTERMS 2010). Consequently, each party shall fulfill the obligations and meet the costs, according to the interpretation given correspond to each equally undergoing those rules INCOTERMS 2010 regarding the transfer of risk.
The cost of preparing, packaging and shipping of products purchased and where applicable VAT and other taxes that are applicable, are borne by the customer, who come to pay them along with the price and in the same way chosen to do the payment of the price. The price listed on the web always includes VAT sales in Spain. Orders to foreign distributors are exempt from VAT.
The price of transportation will be daily updated daily by FEYCSA (LABOR VIVA) to ensure the best economic conditions.
FEYCSA CEE reserves the right to make specific developments which may consist partially or totally not charge the costs of packaging, packaging and shipping for certain purchase amounts may vary and will be suitably publicized.
The delivery of products advertised on the website FEYCSA EEC (LABOR VIVA), both in Spain and abroad, will be 15 working days (Monday through Friday) for products with availability and 30 working days for products not available at the time the order was buying, always counting from the moment that becomes effective collection of the full price, expenses and taxes. These deadlines will be established in the pro-form to be accepted if the client that requested the special circumstances of these limits are exceeded with the agreement of both parties.
FEYCSA (LABOR VIVA) as a manufacturer must deliver the goods covered by the transaction to the carrier in time to meet the agreed delivery time, not responding expenses that may arise during the DISTRIBUTOR as a result of delays in the arrival of the goods to destination, unless such delays had been motivated by failure of delivery time indicated and FEYCSA (LABOR VIVA) could not establish a just cause that had caused the delay.
Manufacturer / supplier / WIN, not be liable to the other or third parties for any resulting damage or loss resulting from the delay or inability to fulfill its obligations in the event of any circumstances beyond their control occurs such as strikes, lockouts, floods, bad weather conditions, natural disasters, embargoes, and other unforeseen and unavoidable contingencies beyond its control.
RIGHT OF WITHDRAWAL FOR CUSTOM ORDERS
I.- Form and exercise period
The Customer may withdraw from the purchase of stationery within seven (7) business days from the date of receipt of the goods if the order does not conform to the pro forma invoice and accepted by the customer design. The date on the receipt of delivery used for the purposes of calculating the period of seven (7) days referred to in this clause. To exercise the right of withdrawal the Customer may complete the withdrawal document provided by FEYCSA EEC (LABOR VIVA, with confirmation, and send it by registered post before the deadline of seven (7) days referred to above, the address indicated therein. for this purpose, the withdrawal document is to be forwarded to the address on the same with the Product in new condition and in its original packaging or, failing that, properly packed for their own means;.. and the original invoice that was issued at the time FEYCSA EEC (LABOR VIVA) customer the right of withdrawal by the customer will not involve the imposition of a penalty the customer must bear the direct cost of return of the product, so the freight collect returns will be rejected. the risks of loss, deterioration or damage to the product to which the withdrawal relates, they are charged to the customer until delivery to FEYCSA EEC
II.- Repeat II order or refund option in case of withdrawal
EEC FEYCSA (LABOR VIVA) addressed under the ISO 9001: 2008 Quality products and services returned merchandise and offer the customer the option to repeat the order adjusting to the pro forma invoice and design originally approved within short as possible and within 15 days of receipt of the goods, assuming FEYCSA EEC (LABOR VIVA) shipping. If that does not be accepted by the customer, FEYCSA (LABOR VIVA) agrees to return the amount paid initially by the product’s initial handling within a period of thirty (30) days after receipt of the Product by FEYCSA EEC (LABOR VIVA) in exercise of the right of withdrawal, provided that the product was received by FEYCSA EEC under the conditions set forth in the preceding clause. In the event that the returned products being damaged, Customer shall indemnify FEYCSA EEC (LABOR VIVA) corresponding to such damage amount, deducting that amount would have to reimburse the Customer subsequently withdrew.
RETURNS WITHOUT CUSTOM ITEMS
As a general rule for items of collections that do not require pro-forma or preliminary design accepted by the customer, FEYCSA EEC (LABOR VIVA) is responsible for the quality of its products and supports the return of any defective products, taking charge of expenses incurred as a result of such repayment and, where applicable, replacement, provided that the client communicates this within seven days from the date of delivery pursuant to contact the email firstname.lastname@example.org.
The parties expressly agree that this Agreement shall be governed and construed in all its terms and conditions, in accordance with current Spanish legislation. All disputes arising from this contract shall be finally settled under the Rules of Conciliation and Arbitration of the Chamber of Commerce of Murcia by one or more arbitrators appointed in accordance with these Rules.
The place of arbitration shall Murcia (Spain).
